1. These terms and conditions apply to the downloading and use of Miele software and data. Downloading implies implicit acceptance of these terms and conditions.
2. Downloads are available 24 hours a day and 7 days a week. Given the nature of the Internet and computer systems, MIELE cannot however guarantee their uninterrupted availability.
3. Downloads are updated by MIELE as and when necessary. MIELE reserves the right to modify data and software without prior notice, in particular in order to embrace technical and economical developments or to make adjustments to account for changes in useage patterns and peripheral conditions, including those of an economic nature.
Terms of use
1. The downloads are protected by copyright. The owners of the copyrights are Miele or other third parties. The reproduction, distribution, transmission, modification, republishing or any other form of copying requires the express prior and written permission of Miele or the owner of the respective copyrights.
2. It is prohibited to copy, resell or loan MIELE software or make it available to unauthorised third parties. Miele software contains trade secrets. For this reason, it is not permissible to reverse engineer, decompile, disassemble or in any other way manipulate the software.
3. MIELE grants the user simple, revokable and non-transferable rights to use the downloads to support commercial processes with respect to existing business relationships with Miele. Copyright references and similar phraseology should be downloaded in their entirety and remain unaltered.
4. MIELE wishes to point out that data is downloaded in an unsecured environment. Miele cannot entirely prevent access to data by unauthorised third parties or the corruption thereof.
Liabilities
1. The information and downloads provided contain no binding guarantees, promises or representations.
2. MIELE cannot assume any responsibility that this data is correct or complete, nor guarantee the quality or reliability of the information or results produced therewith. In no way shall MIELE be liable for direct, consequential or incidental damage resulting from the downloads such as the interruption of service, lost profits and loss of data or information. Downloads provided by Miele should only be used after prior consultation with Miele.
3. MIELE does not assume any liability whatsoever resulting from the use or lack of use of the downloads or from hardware or software errors or incorrect system settings. The use of the downloads is done at the user's own risk and discretion. MIELE shall not assume any liability for software and information, in particular with respect to its fitness for a specific purpose, the validity of its content or its freedom from viruses.
4. MIELE assumes no responsibility for damage caused by viruses, trojan horses, hoax viruses or other code that manifests destructive or damaging properties, or for programmes, parts of programmes or code or the interruption of services resulting from such corrupted data. The user is expected to take precautionary measures to protect against viruses or other destructive data.
5. Miele assumes no responsibility for errors in transmission of data to Miele, the manipulation of such data by unauthorised third parties, in particular through access to Miele networks and systems.6. This does not include cases of intent or gross neglect and does not apply in cases in which guarantees regarding the properties of downloads were made or in the case of infringements against substantial contractual obligations. The same applies to cases of injuries and bodily harm as well as to responsibilities resulting from product liability. Damages resulting from an infringement of substantial contractual obligations is however limited to such damages as are deemed foreseeable and typical in the context of similar contracts. The above does not imply a reversal in the burden of proof to the detriment of the user.
2D and 3D AutoCad files
Planning data enable simple, accelerated and reliable planning using two and three-dimensional front and ground elevations. All planning-relevant data such as dimensions, connections points and on-site supplies are included. Drawing data compiled using AutoCAD 2000 are provided in DWG format. These are compatible with various CAD programmes. The self-explanatory structure directs the user to the drawing file required, which can then be transfered to the existing drawing using drag and drop technology.
Machine drawing files are clearly titled to denote the heating type: "EL" (Electric), "D" (Steam) or "G" (Gas). A "D", "S", "V" or "R" appended to the file name stand for aerial, side, front or rear elevation respectively.
Guarantees and liability: MIELE does not assume any liability for the accuracy of the data. Miele cannot be held responsible, in particular, for the fitness of the data provided for the purposes intended by the user or the interaction of this data with other programs or applications.
The responsibility for the correct selection and the consequences of the data used as well as the intended results lie exclusively with the user. Miele cannot assume any responsibility for direct, incidental or consequental damage.
Exemption from liability does not apply in cases of intent or gross neglect or to the lack of promised properties. Liability to pay damages is in all cases restricted to foreseeable damage. The period of limitation for damage claims is 6 months and commences with the transfer of data.
